Terms and Conditions
Please read these Terms and Conditions ("Terms") carefully before using the website located at providencepoolcare.com (the "Site") or engaging the pool care, cleaning, maintenance, or repair services (the "Services") provided by Providence Pool Care LLC ("Company," "we," "us," or "our"). By accessing the Site or requesting or receiving Services, you ("you," "your," or "Customer") agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Site, submitting a service request, or accepting Services from us, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or engage our Services.
2. Services
Providence Pool Care provides residential and/or commercial swimming pool and spa services, which may include but are not limited to: routine cleaning and maintenance, water testing and chemical balancing, green-to-clean recovery, equipment inspection, repairs and installation, filter service, pool automation, and related pool care services in Gilbert, Chandler, Mesa, Tempe, Queen Creek, and surrounding East Valley communities in Arizona. The specific scope, frequency, and pricing of Services will be set out in a separate service agreement, quote, invoice, or written communication between you and the Company.
We reserve the right to refuse, suspend, or discontinue Services to any customer at our discretion, including where a pool, spa, or property is unsafe to service, inaccessible, or where required conditions are not met.
3. Scheduling, Access, and Customer Responsibilities
You agree to:
- Provide safe and reasonable access to the pool, spa, equipment, and property at scheduled service times, including access through gates, side yards, or other entry points.
- Secure or restrain any pets during scheduled service visits.
- Maintain functioning equipment and disclose any known defects, hazards, or prior damage.
- Ensure the pool's water and equipment are in a condition suitable for service.
- Notify us of any changes affecting access, scheduling, or the condition of your pool.
If our technician is unable to access the property or perform Services due to circumstances within your control (for example, locked gates, unrestrained animals, or unsafe conditions), the visit may be charged as a completed service at our discretion.
4. Text Messaging (SMS) Terms
By providing your mobile phone number to Providence Pool Care — including through our quote form, our contact form, or in the course of doing business with us — you agree to receive text messages (SMS/MMS) from us at that number, including messages sent using automated technology. Consent to receive text messages is not a condition of purchasing any goods or services.
- Types of messages. We may send appointment scheduling and reminders, "on-the-way" and service-completion updates, quotes and estimates, billing and account notifications, and replies to your questions (customer care).
- Message frequency. Message frequency varies based on your interactions with us.
- Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan.
- How to opt out. You can cancel text messages at any time by replying STOP to any message from us. After you reply STOP, we will send a one-time confirmation and will stop sending you text messages.
- Help. Reply HELP to any message for help, or contact us at info@providencepoolcare.com or (520) 800-8220.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Your privacy. We do not sell or share your mobile phone number or your text-messaging consent with third parties or affiliates for their own marketing purposes.
5. Pricing and Payment
Pricing for Services will be provided in your quote, service agreement, or invoice. Unless otherwise agreed in writing:
- Recurring or subscription-based Services are billed monthly, and payment is due upon receipt of invoice or on the billing date specified.
- Additional services, repairs, parts, and chemicals beyond the agreed scope may be billed separately.
- We reserve the right to change pricing with reasonable advance notice.
- Late or unpaid balances may result in suspension of Services and may be subject to a late fee and/or interest as permitted by Arizona law.
Accepted payment methods and billing details will be communicated to you directly.
6. Cancellations and Rescheduling
Either party may cancel or reschedule a service visit by providing reasonable advance notice. Recurring service plans may be canceled by either party with reasonable written notice. Fees already incurred for completed Services are non-refundable except as otherwise required by law or expressly agreed in writing.
7. Repairs, Parts, and Third-Party Products
Where Services include repairs or the supply of parts, equipment, or chemicals:
- Manufacturer warranties, where applicable, are passed through to you and are governed by the terms of the manufacturer. We make no independent warranty on third-party products beyond any manufacturer warranty.
- We are not responsible for pre-existing conditions, latent defects, or damage arising from equipment or installations not performed by us.
- Estimates for repairs are approximate; actual costs may vary, and we will seek your approval before performing work exceeding an agreed threshold where practical.
8. Chemicals and Water Safety
Pool and spa chemicals are hazardous if mishandled. We use commercially reasonable care in the application of chemicals. However, water chemistry is affected by many factors outside our control, including weather, bather load, refills, and equipment performance. We do not guarantee specific water conditions between service visits, and you are responsible for the safe use of your pool, including keeping people and pets away from freshly treated water for any recommended period.
9. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Services and the Site are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, except as expressly stated in a written service agreement.
- Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of use, arising out of or related to the Services or the Site.
- Company's total aggregate liability arising out of or related to the Services shall not exceed the amount paid by you for the Services giving rise to the claim during the three (3) months preceding the event.
Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for gross negligence or willful misconduct.
10. Indemnification
You agree to indemnify and hold harmless Providence Pool Care and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the pool or spa, or conditions on your property outside our control.
11. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is the property of Providence Pool Care or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
12. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of any third-party sites and provide such links for convenience only.
13. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted to the Site with an updated "Last updated" date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
